CPD Live Pty Ltd (business name Cahoot Learning) (“Cahoot Learning”) respects that individuals have a right to privacy, and understands the value and sensitivity of personal information (“personal data”) and confidential information.
Cahoot Learning attaches a great deal of importance to and will pay particular attention to protecting your personal data and to respecting your privacy and confidential information.
2. Purpose
The purpose of this privacy policy and information notice for website users (“notice”) is to inform you of how your personal data is collected, used, distributed, and handled (“processed”) when you visit Cahoot Learning’s website (www.cahootlearning.com “website”). In this regard, please note that Cahoot Learning (“we”, “us” and “our”) acts as the service provider responsible for your personal data.

When you browse our website, the Cahoot Learning web servers, controlled directly or indirectly by Cahoot Learning, make a record of your visit and log the following information:

- The name of your operating system (e.g. Windows 7 or 8, Apple or Linux)
- The protocols used (e.g. http, https, ftp).
Depending upon your activity and preferences, we collect the following categories of personal data about you that you provide to us:
- identification data (e.g., surname, first name, email address, username, password, region, type of device);
- professional data (e.g., position held, field of activity, employer); and
- personal data contained in correspondence you send to us, including through our contact us, email and chat services.
When you complete the Cahoot Learning “Contact Us” Form in addition to the above personal data, we also collect the following personal data about you:
- whether the enquiry is for you or on behalf of someone else e.g., your employer);
- your relationship with that someone else;
Provision of your personal data is voluntary, but we will be unable to provide you with the services and information you request without it. For example, if you contact us through the website, you will need to provide us with your email address so that we can respond to you.
Additionally, if you provide us with personal data belonging to third parties, you undertake to ensure that such persons have been duly informed of the processing of their personal data in accordance with this policy and, if required, have consented to the processing of their personal data.
In any case, we will inform you when it is mandatory to provide your personal data, and we acknowledge your rights under Australian privacy and data protection laws, specifically the Privacy Act 1988 (Cth) (Privacy Act), APP2 to remain anonymous and to use a pseudonym.
4. Cahoot Learning Service Agreement
When you enter into a service agreement with Cahoot Learning (e.g., to participate in our transformative learning experiences and peer-to-peer collaboration), we will collect additional personal data, and you will be provided with a specific information notice on how we process your personal data. We do not need all your personal data when you simply visit the website because the website is to tell visitors to our website about us and the services and products we provide, and not to provide the services themselves.
5. Why do we use your Personal Data?
The table below outlines the purposes that we process your personal data for and, for each purpose, the legal basis for the processing operation in question:

Please note that we will not process your personal data for any other purpose that is incompatible with the above-mentioned purposes.
6. Who do we share your Personal Data with?
In the context of our processing operations, we may communicate your personal data to the following recipients:
- to our service providers, suppliers, agents, and contractors, to the extent that they assist us in carrying out the purposes set out in this policy (e.g., we use IT service providers to host your personal data on our behalf); and
- to competent courts, public authorities, government agencies, and law enforcement agencies (including where we are required to comply with legal or regulatory requests).
Regardless of the recipient, we will only disclose your personal data to them on a strictly need-to-know basis and only to the extent required by law and to fulfill the purposes identified in this policy.
7. Transfer Personal Data outside Australia
Your personal data, as listed above in Section 3, is likely to be transferred to the USA and other jurisdictions where Google Analytics stores data. Where your personal data is transferred outside Australia, we ensure that the level of protection your personal data is given is not adversely affected by such transfers.
This specifically means that we ensure that:
- the overseas recipient does not breach the Privacy Act or the Privacy Principles (APPs);
- the recipient of the information is subject to a law, or binding scheme, that protects your personal data in a substantially similar manner to Australian privacy law;
- there are technical and organisational mechanisms in place to ensure the protection of your personal data and
- there are mechanisms that you can access to take action to enforce your rights.
No transfer of your personal data overseas will be made unless at least one of the below apply:
- Cahoot Learning has entered into a data processing agreement (DPA) with the third party which contains standard contractual clauses and contractual safeguards;
- the existence of an exemption related to one of the specific situations exhaustively provided for by the Privacy Act (e.g. where you have given your consent to such transfer having been informed of the absence of safeguards, where the transfer is necessary for the performance of a contract concluded between you and us, where the transfer is necessary for the conclusion or performance of a contract concluded in your interest between us and a third party, or where the transfer is necessary for the establishment, exercise or defense of our legal claims, etc.);
- in compliance with the permitted general situations in relation to the collection, use or disclosure of personal data (s 16A Privacy Act); and
- the disclosure of the information is required or authorised under an Australian law.
Further, that we will take such steps as are reasonable in the circumstances to protect your personal data from misuse, interference and loss, and from unauthorised access, modification or disclosure.
8. How long do we store your Personal Data for?
We store your personal data for no longer than is necessary for the purpose of the processing concerned, or a legitimate related purpose.
This means that the storage periods we apply vary depending on the purpose for which we process the data in question. The table below indicates, for each purpose, the storage period that will be applied to your personal data:

Our archiving policy ensures that your personal data is not stored in the active database unnecessarily.
In any case, once the applicable storage period has elapsed, we will irrevocably erase or anonymise your personal data irreversibly, so that you can no longer be identified.

10. What rights do you have?
As an individual, the Privacy Act gives you significant control over the way that your personal data is handled. The Privacy Act allows you to:

- ask for access to your personal data;

However, please note that some of the above rights are subject to specific conditions stipulated in law. Therefore, if your specific situation does not meet these conditions, we will unfortunately be unable to comply with your request.

To process your request as efficiently as possible, we may ask you for certain additional information to confirm your identity and/or assist in locating the personal data that forms the subject matter of your request.

- Unsolicited marketing (spam) – Australian Communications and Media Authority (ACMA) here.
Please note also that Australian telecommunication and data surveillance laws limit your right to privacy to some extent. These laws establish a legitimate means for us to monitor and secure our systems and networks, which is an obligation upon us under corporations, cyber security and other laws.

Terms of Use
1. Agreement, Parties, Applicability
CPD Live Pty Ltd (business name Cahoot Learning) (“Cahoot Learning”) (referred to as “we”, “us” and “our”) is an Australian Proprietary company that that provides transformative learning experiences for organisations through peer-to-peer collaboration that drives deep engagement to build capability and shift mindsets.
This website Terms of Use agreement (“agreement”) is to tell visitors to our website about us and the services and products we provide.
Cahoot Learning’s website (www.cahootlearning.com “website”) is provided primarily for information purposes. Cahoot Learning respects that individuals have a right to privacy and understands the value and sensitivity of personal information (“personal data”), and confidential information. When (“you”) as an individual, visit our website and share personal data with us, the terms of this agreement, together with our Privacy Policy published at cahootlearning.com/privacy-terms/ apply.
This agreement is a legal agreement between you as a visitor to the website and us as the registered owner of the website. If you do not agree to these terms, you must not use the website. Continued use means that you agree to these terms.
2. Commencement, Availability, Termination
This agreement commences when you first visit the website and continues until changed or terminated by us. To comply with law and in line with international standards and best practice relating to the use of information technology, we sometimes access static records, and also monitor and intercept live communications and website activity (blocking, filtering, scanning, cookies etc.). While you have our assurance that we will do this in compliance with law, and to manage business risk, you agree that you have no expectation of privacy in this regard.
7. Communication
You agree that we may approach you or send you information, including information about our services. You will always have the choice to inform us in writing that you do not want us to communicate with you and/or to opt-out of these communications.
8. Damages Arising from Email from Cahoot Learning
Information technologies including telecommunication systems and networks expose Cahoot Learning to dynamic security and business risk. Cahoot Learning manages this risk in accordance with Australian law and through its policies, procedures, standards and guidelines to prevent unauthorised access to or abuse of our systems and networks. While Cahoot Learning is committed to a reasonable standard of care and diligence, Cahoot Learning cannot and will not be liable for damages arising from any use of its website which is beyond its control.
9. Complaints and Alternative Dispute Resolution
You agree to submit all complaints relating to this agreement to us first, so that we have an opportunity to resolve your complaint before you proceed to any relevant authority. Please direct all complaints to hello@learningplatform.app. Subject to the above, you agree to confidential arbitration prior to issuing any proceedings in a court or other forum. You expressly acknowledge that, by agreeing to have disputes resolved by arbitration, you are prevented from entering into a class action lawsuit against us in relation to any dispute arising from this agreement. Nothing in this agreement prevents either us or you from approaching a court of competent jurisdiction for injunctive relief on an urgent basis.
10. Enforceability
No failure or delay by us or you to exercise a right in this agreement shall prevent us or you from exercising our respective rights in future. If a term of this agreement is invalid, unenforceable or illegal, the remaining terms shall continue in full force and effect.
11. Limitation of Liability, Indemnity, No Warranty
You agree that the website is provided on an “as is” and “as available” basis and that your use of our website is at your sole discretion and risk. You agree that we will not be liable for any direct, indirect or consequential damages suffered by you arising from your visit to the website, this agreement or otherwise. We will take reasonable care to ensure the accuracy of information and the availability of the website, but make no representations, warranties or guarantees in any way because it is provided for general information purposes, at our discretion alone, and is dependent upon third-party service providers. 13. Cahoot Learning Platform (Additional Terms Apply)
We provide a link to the Cahoot Learning Platform https://learningplatform.app (“Cahoot Learning”) via the website for individuals to participate in our transformative learning experiences and peer-to-peer collaboration. You acknowledge and agree that the terms of use of Cahoot Learning and the privacy policy and information collection notice applicable to Cahoot Learning are different from and in addition to the Privacy Policy and Information Notice applicable to the website. If and when you participate in Cahoot Learning, you will have the opportunity to consent to the relevant terms and policies relating to peer-to-peer collaboration on an informed, voluntary, current, and specific basis, before gaining access to the course content. This is because we want express consent due to the kinds of personal data that is processed and shared when learning.
14. Governing Law
This agreement shall be governed by and interpreted in accordance with the laws of Victoria, Australia.
15. Skill, Diligence, Care
We will exercise reasonable skill, diligence and care as may reasonably be expected from a similar website provider.

Cahoot Learning is committed to providing a user-friendly website and online learning platform that is accessible and enjoyed by all of our learners, including those with disabilities.
Cahoot Learning continuously works to increase the accessibility and usability of its website. In so doing Cahoot Learning seeks to comply with globally recognized standards and guidelines, in particular level AA of the World Wide Web Consortium (W3C) Web Content Accessibility Guidelines 2.1.
Cahoot Learning commissioned Digital Access at Vision Australia to undertake an Accessibility Audit and Post-rectification Review on the Cahoot Learning Platform in line with the internationally recognised Website Accessibility Conformance Evaluation Methodology (WCAG-EM) 1.0. As of October 2020, the platform satisfied all Level A and Level AA success criteria of the Web Content Accessibility Guidelines (WCAG) 2.1 specification.
These guidelines explain how to make web content more accessible for people with disabilities, conformance will improve the web experience for all users.

The primary business of Cahoot Learning is the development and delivery of digital learning solutions for a changing professional world. As a business focused on people development, Cahoot Learning believes that an excellent company is by definition and practice a safe company. Since Cahoot Learning is committed to excellence, it follows that minimising risk to, and promoting the wellbeing of, people and the environment is inseparable from all other company objectives, as is reflected in the values of the company (About Us).

Cahoot SHEQ Policy applies to all of its operations, and to services that may be delivered by organisations or individuals in conjunction with Cahoot Learning. The primary business of Cahoot Learning is the development and delivery of digital learning solutions for a changing professional world. As a business focused on people development, we believe that an excellent company is by definition a company committed to sustainable business practices. This policy provides an outline of how Cahoot Learning is operating sustainably and managing its impact on the environment. Cahoot Learning strives to be a good corporate citizen and lead by example in operating sustainably.
Cahoot Learning’s Sustainability Policy applies to all its Australia Operations and to services delivered by associated organisations globally. Guiding principles for the Policy are:
To comply with, and exceed where practicable, all applicable legislation, regulations and codes of practice;
To integrate sustainability considerations into our business decisions;
To ensure that all staff are fully aware of our Sustainability Policy and are committed to implementing and improving it;
To minimize the environmental impact and increase the sustainability of all office and transportation activities;
To make clients and suppliers aware of our Sustainability Policy and encourage them to adopt sound sustainable management practices;
Give preference to suppliers taking into consideration their sustainability practices; and

The process
Travel and meetings:
- Where alternatives are available and practical, minimise travelling to meetings or gatherings e.g. using online resources;
- Time meetings efficiently to avoid multiple trips;
- Walking and/or use public transport to attend meetings, site visits and gatherings, whenever possible and practical;
- Facilitate regular client contact by providing virtual training and webinars to clients.
Purchase of equipment and consumption of resources:
- Minimise our use of paper and other office consumables e.g. by double-siding all paper used, and identifying opportunities to reduce waste;
- Arrange for the reuse or recycling of office waste where possible e.g. paper, computer supplies, and redundant equipment;
- Reduce battery use by replacing with rechargeable batteries in all practical situations; disposing of used batteries in recycling collection points;
- Reduce the energy consumption of office equipment by purchasing energy efficient equipment and practicing good housekeeping;
- Pay special attention to consumables most highly used in Mirus the Cahoot
- Learning office e.g. toilet paper, coffee, copy paper, printer toners, and paper towels, and opt for the most suitable sustainable option and recycling waste;
- Ensure that consumables, whenever available, are from sustainable and/or fair-trade origins.
Working practices
- Ensure that any staff and associates that we employ take account of sustainability issues in their working practices;
- Ensure all clients, future clients, and suppliers are aware of and have access to our sustainability policy.
