Cahoot Learning Terms of Use

Welcome to the Cahoot Learning platform,comprising Cahoot Learning websites and   applications, together with related services,including any course or other learning experience (Course) delivered on the Cahoot Learning platform (Site).
The following Terms of Use on this Site (Terms) are a contract between you and Cahoot Learning. By accessing, browsing or using the Site, whether or not you are registered for a course offered by or through Cahoot Learning, you agree to be bound by, and comply with, these Terms.

These Terms are for your protection and enjoyment of the Site as well as all other users of the Site.

Cahoot Learning recognises that you may be using this Site independently or as part of what is provided to you by your employer or other third party sponsor that has engaged Cahoot Learning in relation to your use of this Site. Such employer or third party sponsor has agreed with Cahoot Learning that all users of this Site will be subject to these Terms. You may also be required to agree to further terms of your employer, third party sponsor, and/or third party owner of content related to a Course.

1. Copyright and limited permission to use site content

The contents of this Site (Site Content) are covered by copyright laws in Australia, the United States and other relevant countries. Unless otherwise specifically agreed or permitted for purposes of participating in a Course or other application for which you are registered in respect of which you have access to use the Site, you may use Site Contents for personal, non-commercial purposes only and you may not copy or reproduce Site Content or infringe the copyright, trademarks or other rights of any of the owners of Site Content.

2. Prohibited conduct

You must not:
  1. Collect personal information about a person without their permission, impersonate any other person or falsely claim any affiliation with any other person or entity;
  2. Post, email, publish or distribute material or content that defames or threatens others or contains harassing statements, discusses illegal activities with the intent to commit them, infringes another’s intellectual property (including, but not limited to, copyrights, trademarks or trade secrets), contains obscene (i.e. pornographic) language or images, is advertising or any form of commercial solicitation or is unlawful;
  3. Remove, disable or interfere with any security related features of the Site, take part in a denial of service type attack on the Site or otherwise interfere with or damage the Site; or
  4. Reverse engineer, disassemble, decompile or otherwise attempt to determine the Site’s source code.

3. User Postings

Submitting postings and other material to the Site (Postings) forms an integral part of the value and enjoyment of the Cahoot Learning experience for you and other users of the Site. It is therefore important that you feel safe and secure in sharing your Postings with your cohort of learners in the Site. Cahoot Learning takes your privacy and the security of your data seriously, and adheres to the requirements of the Australian Privacy Principles (under the Privacy Act 1988) in relation to Postings. It is also important that you respect the privacy and security of other users of the Site in relation to their Postings. By using this Site and submitting Postings, you:
  1. Warrant that your Postings do not infringe copyright, trademarks or any other rights of any person;
  2. Acknowledge and accept that your Postings will likely be seen by and commented on by other parties using the Site which could include your cohort of learnings, facilitators, owners and providers of Site Content, and may also be your employer or third party sponsor; and
  3. Acknowledge that you are solely responsible for your Postings and the consequences of posting them.

4. Copyright claims

Copyright owners who believe their material has been infringed on the Site should contact Cahoot Learning at hello@learningplatform.app. You must include:
  1. Identification of the copyrighted work, or, in the case of multiple works at the same location, a representative list of such works at that site;
  2. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, including sufficient information to allow for the location of the material (e.g., URL, IP address, computer name);
  3. Contact information for the complaining party (e.g., email address, phone number); and
  4. A statement that the complaining party believes that the use of the material has not been authorized by the copyright owner or an authorized agent.

5. Cahoot Learning’s Limitation of liability

Cahoot Learning provides the Site, the Site Content and related services on an “as is” and “as available” basis. You use the Site at your own risk and Cahoot Learning:
  1. Gives no warranty of any kind (express, implied or otherwise) about the Site or Site Content including, without limitation, any implied warranties of merchantability, fitness for a particular purpose, availability, timeliness, accuracy and non-infringement, except insofar as any such implied warranties may not be disclaimed under applicable law;
  2. Has no liability to you for any loss or damage (whether to property or by way of financial loss or consequential loss) you may suffer from use of the Site, including downloading data from or through the Site or other sites linked to the Site; and
  3. To the fullest extent permitted by applicable law, is not liable for any consequential, indirect, punitive, special, exemplary, or incidental damages, whether foreseeable or unforeseeable, and whether or not Cahoot Learning has been negligent or otherwise at fault (including, but not limited to, claims for defamation, errors, loss of profits, loss of data, or interruption in availability of data).

6. Privacy and Accessibility

Please read the Privacy Policy and Accessibility Policy which form part of these terms.

7. Termination/Suspension

Cahoot Learning, at its sole discretion, may:
  1. Close the Site and terminate any services provided through the Site at any time and for any period or permanently; and/or
  2. Bar any person from accessing the Site for any period or permanently.

8. Variation

Cahoot Learning reserves the right to modify these Terms at any time without advance notice. Any change will take effect from the time it is posted to the Site. By accessing the Site after any changes have been made, you signify your agreement on a prospective basis to the modified Terms.

9. Waiver

No failure by Cahoot Learning to exercise nor any delay in exercising any right, power or remedy under these Terms operates as a waiver. A single or partial exercise or waiver of the exercise of any right, power or remedy does not preclude any other or further exercise of that or any other right, power or remedy. A waiver is not valid or binding unless made in writing.

10. No other terms

Except where you are registered for a Course provided by Cahoot Learning itself, in which case you may be subject to additional terms with Cahoot Learning applicable to that course, these Terms set out the entire agreement between you and Cahoot Learning and supersedes all earlier conduct or prior agreements and understandings between Cahoot Learning and you in connection with your use of the Site.

11. Governing law

These Terms are governed by the laws of the State of Victoria in the Commonwealth of Australia and you submit to the non-exclusive jurisdiction of the courts of Victoria.

12. Cahoot Learning

The Cahoot Learning website is owned and operated by CPDlive Pty Ltd (CPDlive) of Melbourne, Australia. Cahoot Learning is the registered trademark of CPDlive. Any reference to Cahoot Learning or Cahoot in these Terms of Use is also a reference to CPDlive.

Cahoot Learning Privacy Policy

Cahoot Learning is committed to protecting your privacy which forms part of the ongoing trust that Cahoot Learning wishes to build with you. This policy sets out how Cahoot Learning complies with the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Privacy Act). The APPs set out how Cahoot Learning must handle your personal information. ‘Personal information’ is information or opinion about an identified individual, or an individual who is reasonably identifiable. The information or opinion may or may not be true and may or may not be recorded in a material form.

What kind of information Cahoot Learning collects

When you make any purchase through the Site, register for a course or otherwise make use of the Site, you may be required to provide your username and password, name, organisation, email address, telephone number, mailing address, cardholder name, credit card type (e.g. AMEX, Visa), credit card number and credit card expiry date.

This allows Cahoot Learning to process and fulfil your purchase requests and to notify you of your purchase status. If you do not supply all this information, then Cahoot Learning cannot process your payment, supply you with what you have purchased or notify you of the status of your purchase request.

When you look at the Site, undertake courses delivered through the Site or otherwise use the Site, the Cahoot Learning web servers, either controlled directly or indirectly by Cahoot Learning, make a record of your visit and log the following information for purposes of the agreement that it has with you and also for statistical analysis or system administration purposes:
  1. Your Internet Protocol (IP) address (e.g. 123.246.123.246) and/or fully qualified domain name (e.g. www.cahootlearning.com)
  2. The date and time of your visit to the site
  3. The web pages which you accessed, the files you downloaded and the sizes of those pages/files
  4. If you followed a link to the Site (e.g. from a search engine), the name of the previous web page and the name of the web site you visited
  5. The type and version of your web (e.g. MS Internet Explorer, Firefox or Chrome)
  6. The name of your operating system (e.g. Windows 7 or 8, Apple or Linux)
  7. The protocols used (e.g. http, https, ftp).
Search terms that you provide when you search the Site are collected for statistical analysis, to understand what users are looking for on the Site and to improve the products and services which Cahoot Learning provides.

A cookie is some textual information which a web server sends to your web browser. Your web browser usually stores this information somewhere on your computer’s hard disk. The web server may retrieve this information from your web browser whenever a web page is sent to you. The Cahoot Learning web servers generate a single cookie which is used to let us know who you are, to deliver information, publications and services to you based on your account information and to keep track of the Cahoot Learning web pages which you visit while you are using the Site. The Cahoot Learning cookie contains an organisation identity number (if any), user type, group identity number (if any), user identity number and the browser session identity number.

How to control cookies

If you do not wish to receive any cookies you may set your browser (such as Firefox, Google Chrome, Internet Explorer or Safari) to either prompt or refuse cookies. Please note that rejecting cookies may mean that not all the functions on the Site will be available to you.

What kind of information is collected by others

When you look at or otherwise use the Site, Cahoot Learning’s Internet Service Provider (ISP) and your Internet Service Provider may also make a record of your visit and collect some or all of the same, or similar, information as the Site.

The Site may work with third party sites that collect anonymous traffic data at this site from traffic referred by external search engines.

These third parties may use cookies and other anonymous identifiers and may create anonymous profiles associated with cookies or other anonymous identifiers, but will not associate any data gathered with any personally identifying information from any source.

When you follow a link from the Site to a third-party web site, that web site may also make a record of your visit and collect some or all of the same, or similar, information as the Site.

The Site does not currently use any third-party advertisement service(s) for the serving and/or targeting of advertisements, promotions or other marketing information.

The information collected by any of the third parties noted above is not subject to this privacy policy.

It should be noted that Cahoot Learning has no control over, and does not accept any responsibility for, the privacy and information collection practices of these third parties.

How Cahoot Learning uses the information it collects

Your personal information that you provide to Cahoot Learning is kept for the following purposes:
  1. To provide you with that which you have acquired or requested from Cahoot Learning
  2. To send you communications in relation to what you have acquired or requested
  3. If you access the Cahoot Learning platform as part of your participation at a conference or event, Cahoot Learning reserves the right to communicate with you in relation to your participation in the platform.
  4. Internal accounting and administration
  5. To protect you and Cahoot Learning from fraud
  6. To help Cahoot Learning identify other products or services that might be beneficial to you, and inform you about them, if you have requested this
  7. To inform you about updates or changes to the product or service you have acquired
  8. For statistical purposes.

How Cahoot Learning protects the information it collects

To protect the privacy of your information, Cahoot Learning continuously monitors its compliance with the various privacy obligations imposed by law as well as those which it voluntarily undertakes.

Whenever you register or make purchases from the Site, Cahoot Learning uses current technology to encrypt the information. This ensures that the information sent to and from its secure web server from and to your personal computer is for your eyes only.

Online access to your information, products and services is protected by your Cahoot Learning username and password which must be provided before you can gain access to your information, products and services.

You should remember that it is your responsibility to you to keep your username and password secret so that they cannot be used by anyone else.

All collected information is stored on servers. Cahoot Learning believes that this information can only be accessed by you and by authorised Cahoot Learning staff and service providers.

Cahoot Learning also uses state-of-the-art hardware and software measures to protect the information which it collects from you from misuse, loss, unauthorised access, modification or disclosure.

So that we can ensure that your credit card information is as secure as possible this area of the website is capable of working with web browsers using high-security encryption.

Cross border transfer of data

Personal information may be transferred between countries for processing, storage or support services. If your information is transferred, Cahoot Learning will take steps to protect your personal information in a manner consistent with this policy.

What information Cahoot Learning shares and how

Cahoot Learning will not share your information with anyone. Exceptions may occur where:
  1. Cahoot Learning reasonably believes in good faith that you have consented
  2. A law enforcement agency, or other government agency, is exercising its legal authority and has asked Cahoot Learning to provide access to that information
  3. That information is required to help identify any abuse or attempt to abuse or compromise the integrity or security of the Site or any web sites connected to them
  4. Cahoot Learning discloses anonymous, aggregated, statistical information to non-Cahoot Learning third parties such as advertisers, promoters and partners
  5. Where Cahoot Learning has outsourced any aspect of providing services to you to third parties, in which case Cahoot Learning will ensure that all third parties deal with your personal information according to the same standards as ascribed to by Cahoot Learning.

Your control over the information Cahoot Learning collects

You have a right to access the personal information Cahoot Learning store about you. If you find that this information is inaccurate, incomplete or out-of-date, then Cahoot Learning will correct it. If you wish to access your information, then please email hello@learningplatform.app.

To assist Cahoot Learning to deal with your request within a reasonable period of time, it will need to verify your identity. To this end, please include in your email the following information:
  1. Your name
  2. The name of your organisation
  3. The subject matter of concern.

Child users

The Site is not for the use of children under 13 years of age. If you are under 13 years of age please do not access or use the Site. If Cahoot Learning becomes aware that a child under 13 years of age has accessed this Site, and Cahoot Learning has collected any personal information from or about them, it will delete that information.

Changing Cahoot Learning Privacy Policy

Cahoot Learning reviews its Privacy Policy from time to time and may change it as a result. Any change will take effect from the time it is posted to the Site.

Cahoot Learning is committed to providing a user-friendly website and online learning platform that is accessible and enjoyed by all of our learners, including those with disabilities.
Cahoot Learning continuously works to increase the accessibility and usability of its website. In so doing Cahoot Learning seeks to comply with globally recognized standards and guidelines, in particular level AA of the World Wide Web Consortium (W3C) Web Content Accessibility Guidelines 2.1.

Cahoot Learning commissioned Digital Access at Vision Australia to undertake an Accessibility Audit and Post-rectification Review on the Cahoot Learning Platform in line with the internationally recognised Website Accessibility Conformance Evaluation Methodology (WCAG-EM) 1.0. As of October 2020, the platform satisfied all Level A and Level AA success criteria of the Web Content Accessibility Guidelines (WCAG) 2.1 specification.

These guidelines explain how to make web content more accessible for people with disabilities, conformance will improve the web experience for all users.
